Terms of Service
The agreement between you and Advance for using the app.
These Terms of Service (“Terms”) are a binding agreement between you and Advance (“Advance,” “we,” “us”), operated by Rami El-Abidin. They govern your use of the Advance application at app.advancetouring.com and related sites and services (the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
1. Eligibility and accounts
You must be at least 16 years old to use the Service. If you use the Service on behalf of a band, business, or other organization, you confirm that you have authority to bind it to these Terms.
You are responsible for your account, for keeping your login credentials secure, and for all activity under your account. Notify us at hello@advancetouring.com if you suspect unauthorized use.
2. The Service
Advance helps musicians and their teams manage shows, tours, advances, settlements, day sheets, and related workflows. A team represents one artist, and members have roles. For example, an admin has full access, while an artist has limited access that excludes deal and settlement data and certain settings. We may add, change, or remove features over time.
3. Plans, billing, and payment
Advance offers a free plan and paid subscription plans. You can start on the free plan without a credit card. The terms in this section describe how paid subscriptions work.
Some features and higher usage limits require a paid subscription. If you subscribe:
- You authorize us (and our payment processor) to charge the applicable fees on a recurring basis until you cancel.
- We bill fees in advance, and except where the law requires otherwise, they are non-refundable. You are responsible for applicable taxes.
- We may change pricing for future billing periods, and we will give you reasonable notice before a change affects your renewal.
- You can cancel at any time, and your access continues until the end of the current billing period.
4. Your content and responsibilities
You own the content you put into the Service (show data, contacts, documents, and so on). You grant us a limited license to host, process, and display that content only to operate and provide the Service to you, including parsing advances with AI and sending the day sheets or invites you choose to send.
You are responsible for the content you add, and you confirm that you have the rights and permissions to add it. This includes any personal information about other people (such as promoters, venue contacts, or crew) and a proper basis to store and share it through the Service.
5. Acceptable use
You agree not to:
- Use the Service to break the law or violate the rights of others.
- Send spam, harassment, or unlawful content through the Service’s email, guest link, or sharing features.
- Try to gain unauthorized access to the Service, other accounts, or our systems, or probe or circumvent security or rate limits.
- Reverse engineer, scrape, or resell the Service except where the law allows it.
- Interfere with or disrupt the integrity or performance of the Service.
6. Guest links and sharing
The Service lets you generate tokenized links and send emails so people without accounts (e.g. promoters, venue contacts) can view show information. You are responsible for who you share these with and what you share. We may rate-limit or disable sharing features to protect the Service and the people who use it.
7. AI features
The Service uses AI to extract structured details from advances and documents. AI output can be incomplete or inaccurate. It is there to assist you, not to replace your judgment. Review parsed information before you rely on it, especially schedules, financial figures, and contacts. AI features do not provide professional, legal, or financial advice.
8. Third-party services
The Service integrates with third-party services (for example, Google sign-in, Google Maps, and an optional Slack connection). Their own terms and privacy policies govern your use of those services, and we are not responsible for them.
9. Intellectual property
We and our licensors own the Service, including its software, design, and branding, and intellectual-property laws protect it. These Terms grant you no rights in the Service beyond the limited right to use it as described. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them with no obligation to you.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if we need to protect the Service or other people, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive (such as content licenses for backups, disclaimers, and limitation of liability) will survive.
11. Disclaimers
We provide the Service “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI output will be accurate.
12. Limitation of liability
To the maximum extent the law permits, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the 12 months before the claim, or (b) USD $100.
13. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) that arise from your content, your use of the Service, or your violation of these Terms or the rights of others.
14. Changes to the Service and Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will update the “Last updated” date and, where appropriate, let you know. If you keep using the Service after the changes take effect, you accept the updated Terms.
15. Governing law and disputes
The laws of the State of New York, USA govern these Terms, without regard to conflict-of-laws rules.
